Welcome to O Menino do Uber ("we," "us," "our," or "the Site"), owned and operated by Thiago Dutra ("Thiago") and based in Boston, Massachusetts, United States. These Terms of Use ("Terms") govern your access to and use of www.omeninodouber.com and any related digital products, mentorship sessions, materials, and communications (collectively, the "Services").

By accessing the Site, purchasing a product, or attending a mentorship session, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase any Services.

1. Eligibility

To use the Site or purchase any Services, you must:

Be at least 18 years old
Have the legal capacity to enter into a binding contract
Provide accurate, current information when purchasing or contacting us

The Services are designed for individuals interested in driving for third-party rideshare platforms. You are solely responsible for confirming that you are legally permitted to drive for Uber, Lyft, or any other rideshare platform in your jurisdiction, including holding all required licenses, registrations, insurance, and work authorizations.

2. Description of Services

We offer educational content and one-on-one guidance for rideshare drivers, including but not limited to:

1:1 Online Mentorship — private video calls with personalized strategy
100+ Strategic Points in Boston — a downloadable digital file delivered by email
Airport Mentorship — guidance on operating at Boston Logan International Airport
World Cup 2026 Boston — strategy content related to matches at Gillette Stadium in Foxborough, MA

Service descriptions on the Site are provided in good faith and may be updated, modified, or discontinued at any time without notice.

3. Purchases and Payments

All purchases are processed through Stan Store, a third-party payment and delivery platform. By completing a purchase, you also agree to Stan Store's terms of service and privacy policy, which apply to the transaction. We do not collect or store your payment card information.

Prices are listed in U.S. dollars and are subject to change. You are responsible for any applicable taxes.

4. Refunds

4.1 7-Day Return Window

You may request a refund within seven (7) calendar days from the date of purchase, subject to the following conditions:

Downloadable digital products (such as the 100+ Strategic Points file) are eligible for a refund only if the file has not been downloaded, opened, forwarded, or otherwise accessed. Once the file has been accessed, the product is considered delivered and used.
Mentorship sessions are eligible for a refund only if the session has not yet been attended. No-shows and completed sessions are not eligible.
Event-specific products (such as World Cup 2026 Boston content) are eligible for a refund within the 7-day window, provided the related event period has not yet begun.

Refund requests submitted within the 7-day window that meet the conditions above will be honored.

4.2 After the 7-Day Window

Once the 7-day return window has expired, refunds are evaluated on a case-by-case basis at the sole discretion of Thiago Dutra. Submitting a late refund request does not guarantee approval. Factors considered may include, without limitation: whether digital materials have been downloaded or accessed, whether mentorship sessions were attended or no-showed, the time elapsed since purchase, and the reason for the request.

4.3 How to Request a Refund

To request a refund, contact us using the channels listed in Section 14 and include your name, order date, product purchased, and reason for the request. Approved refunds are processed through Stan Store and may be subject to its processing timelines.

5. Delivery of Digital Products

Digital products (such as the 100+ Strategic Points file) are delivered to the email address provided at checkout, typically within minutes of purchase. You are responsible for:

Providing a valid, working email address
Checking your spam, junk, or promotions folders
Contacting us if you do not receive your product within 24 hours

Once a digital product has been delivered to the email on file, it is considered delivered, even if you later misplace it.

6. Mentorship Sessions

If you purchase a mentorship session:

You must schedule the session within the timeframe communicated at the time of purchase
You are expected to arrive on time; late arrivals do not extend the scheduled session length
Rescheduling is allowed with reasonable notice (typically at least 24 hours in advance)
No-shows are not refunded or rescheduled, except at our sole discretion

Mentorship is provided as strategic guidance only. Implementation of any advice is entirely up to you.

7. Intellectual Property

All content on the Site and within the Services — including text, graphics, photos, videos, downloadable files, strategy lists, mentorship discussions and recordings, and the "O Menino do Uber" name, logo, and branding — is the property of Thiago Dutra and is protected by U.S. and international copyright and trademark laws.

You are granted a personal, non-transferable, non-exclusive, revocable license to use the materials for your own driving activities only. You may not:

Resell, redistribute, share, sublicense, republish, or commercially exploit any materials
Post the contents publicly online or share them in driver group chats, WhatsApp groups, forums, or social media
Record, transcribe, or reproduce any portion of a mentorship session without our prior written consent
Use the materials to create a competing product, course, or service
Remove or alter any copyright, trademark, or attribution notices

Violation of this section may result in immediate termination of your access and potential legal action, including claims for damages and attorneys' fees.

8. Disclaimers

8.1 No Affiliation with Third Parties

O Menino do Uber is an independent educational service and is NOT affiliated with, endorsed by, sponsored by, or in any way officially connected to Uber Technologies, Inc., Lyft, Inc., the Massachusetts Port Authority (Massport), Boston Logan International Airport, FIFA, U.S. Soccer, the Kraft Group, Gillette Stadium, or any other rideshare platform, sports league, airport authority, stadium, or government entity referenced on the Site. All third-party trademarks, service marks, and trade names are the property of their respective owners and are used only for descriptive purposes.

8.2 No Earnings or Results Guarantee

We make no guarantee, representation, or warranty regarding the income, profit, earnings, ride volume, or financial results you will achieve from applying the strategies, tips, or information provided. Driver results vary widely based on hours worked, vehicle type, location, time of day, market conditions, season, weather, individual driving habits, platform algorithm changes, and many other factors outside our control. Past results — yours, ours, or any other driver's — do not predict future results.

8.3 Educational Content Only — Not Professional Advice

All content is provided for general educational and informational purposes only. It does NOT constitute legal, tax, financial, insurance, immigration, employment, or any other form of professional advice. You should consult a licensed attorney, accountant, insurance agent, or other qualified professional for advice specific to your situation before making decisions that may have legal or financial consequences.

8.4 Your Responsibility for Compliance

You are solely responsible for complying with all applicable laws, regulations, and the current Terms of Service of the rideshare platforms you use (including but not limited to Uber and Lyft), as well as the rules of any airport, stadium, event venue, municipality, property owner, or public agency where you operate your vehicle. Platform rules and local laws change frequently and without notice. We are NOT responsible for any tickets, fines, towing, deactivations, suspensions, account losses, civil or criminal penalties, immigration consequences, or other adverse outcomes you may experience.

8.5 "As Is" Basis

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Thiago Dutra, O Menino do Uber, or any affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including, without limitation, lost profits, lost earnings, lost data, lost driving opportunities, vehicle damage, fines, tickets, towing charges, deactivation from any platform, loss of work authorization, or any other losses — arising out of or related to your use of the Site or Services, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or related to the Services shall not exceed the amount you actually paid us for the specific Service giving rise to the claim in the three (3) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Thiago Dutra, O Menino do Uber, and any affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or third-party right, including any rideshare platform's Terms of Service; or (d) any traffic violation, accident, injury, or other incident that occurs while you are driving or operating a vehicle.

11. Prohibited Conduct

You agree not to:

Use the Services for any unlawful, fraudulent, or harmful purpose
Misrepresent your identity, age, or affiliation
Attempt to gain unauthorized access to any part of the Site or its systems
Interfere with, disrupt, or overload the Site
Use any automated means (bots, scrapers, etc.) to access the Site
Share login credentials, mentorship recordings, downloadable materials, or any proprietary content with any third party
Use the Site or Services to harass, defame, or harm any other person

12. Third-Party Links and Services

The Site contains links to third-party websites and platforms, including Stan Store and Instagram. We are not responsible for the content, accuracy, terms, security, or privacy practices of any third party. Your interactions with third-party services are solely between you and that third party, and you access them at your own risk.

13. Modifications and Termination

We may modify these Terms at any time by posting an updated version on the Site. The "Last Updated" date at the top reflects the most recent revision. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

We reserve the right to suspend, restrict, or terminate your access to the Services at any time, with or without notice, for any reason, including suspected violation of these Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts.

16. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements.
